Domestic ViolenceThe law has recently changed in this regard. It is now as easy to obtain an interdict against your intimate partner as it is to ride a bicycle. This, of course, has both ups and downs. Battered women don't have to be interrogated by some callous uncaring magistrate before the law will protect her against her abusive husband. However, a malicious spiteful person can also obtain an interdict on the most spurious of reasons and then threaten to have the other person jailed if he or she doesn't cow-tow to that person's every demand. If you are in a relationship, or even think that you might be in a relationship, all you need to do is go to your local Magistrates' Court, find the official in charge of domestic violence interdicts, fill out a form and, hey presto!, you have an interdict. These interdicts act as temporary orders against the other person and both of you have to appear in court at a later predetermined date to argue why the order should be confirmed or discharged. If you don't know where your Magistrates' Court is, dial 1023 and ask the operator to give you the number for the court in your town, city or district. |
